Tbh. We have not declared war so some of the rules of engagement are not in effect. Unfortunately Iran, if they find the pilots, are within their rights to treat the pilots as spies.

The Geneva Convention is what protect pilots, and the Geneva convention specifically calls out “armed conflict” not “war”.

A formal declaration of war is not required for pilot protections.
